​No Surprises Act of the 2021 Consolidated Appropriations Act

This disclaimer serves to inform the prospective insurance subscriber/responsible party (here after “you”) that Bay Area Dental Surgery Center nor its providers are contracted with any commercial medical insurance plans. Receiving treatment at this ambulatory surgery center is optional. You may seek care for your dependent from an available participating provider, with respect to your insurance plan or coverage. In doing so, you would not exceed the responsibility that would apply with respect to such an item or service that is furnished by a participating provider and /or facility. The insurance plan(s) may require prior authorization or other care management limitations could apply in advance of receiving such items or services at this facility. Bay Area Dental Surgery Center will attempt to obtain prior-authorization for diagnosed treatment and expected items before the surgery appointment is scheduled. Prior authorization is not a guarantee of full payment. In the event of uninsured or cash payment of uncovered services or items, in accordance with the Consolidated Appropriations Act, 2021,  No Surprise Act, a Good Faith Estimate will be provided with detail before the surgery appointment or upon your request. The Good Faith Estimate shows the costs of items and services that are reasonably expected for your dependent’s health care needs. The estimate is based on information known at the time the estimate was created. Understand that payment of such charges may not accrue toward meeting any limitation that your insurance plan or coverage has in place, whether it be on cost sharing, in-network deductible, or out-of-pocket maximums. The Good Faith Estimate does not include any unknown or unexpected costs that may arise during treatment. You could be charged more if complications or special circumstances occur. If this happens, federal law allows the responsible party to dispute (appeal) the bill. You may contact Bay Area Dental Surgery Center to notify us that the billed charges are higher than the Good Faith Estimate. You may contact Bay Area Dental Surgery Center to negotiate the bill, or ask if there is financial assistance available. You may also start a dispute resolution process with the U.S. Department of Health and Human Services (HHS). If you choose to use the dispute resolution process, you must start the dispute process within 120 calendar days (about 4 months) from the date on the original bill. There is a $25 fee to use the dispute process. If the agency reviewing the dispute agrees with you then the Good Faith Estimate amount will be owed. If the agency disagrees with you and agrees with Bay Area Dental Surgery Center, you will be required to pay the higher amount. Esta clausula de responsabilidad sirve para informarle al suscriptor del seguro [en adelante, “usted”] que Bay Area Dental Surgery Center ni sus proveedores tienen contrato con ningún plan de seguro médico comercial. Recibir tratamiento en este Centro de Cirugía Ambulatorio es opcional. Usted tiene la opción de buscar atención para su dependiente con un proveedor participante disponible, con respecto a su plan de seguro o cobertura. Al hacerlo, no excederá la responsabilidad que se aplicaría con respecto a dicho servicio proporcionado por un proveedor o centro participante. Los planes de seguro pueden requerir autorización previa o podrían aplicarse otras limitaciones de administración de cuidados antes de recibir dichos servicios en este centro. Bay Area Dental Surgery Center intentará obtener una autorización previa para el tratamiento diagnosticado y los servicios esperados antes de programar su cita para la cirugía. La autorización previa no es una garantía de pago completo. En caso de pago en efectivo o falta de seguro por servicios no cubiertos, de acuerdo con la Ley de Asignaciones Consolidadas de 2021 (CAA), Ley de No Sorpresa, se proporcionará un Estimado de Buena Fe con detalles antes de la cita de cirugía o cuando usted lo solicite. El Estimado de buena fe muestra los costos de los servicios que razonablemente se esperan para la atención médica de su dependiente. La estimación de buena fe no incluye ningún costo desconocido o inesperado que pueda surgir durante el tratamiento. Se le podría cobrar más si ocurren complicaciones o circunstancias especiales. Si esto sucede, la ley federal permite que el asegurado impugne (apele) la factura. Puede comunicarse con Bay Area Dental Surgery Center para notificarnos que los cargos facturados son más altos que el Estimado de buena fe. Puede comunicarse con Bay Area Dental Surgery Center para negociar la factura o preguntar si hay asistencia financiera disponible. También puede iniciar un proceso de resolución de disputas con el Departamento de Salud y Servicios Humanos de los EE. UU. (HHS). Si elige utilizar el proceso de resolución de disputas, debe iniciar el proceso de disputa dentro de los 120 días (alrededor de 4 meses) a partir de la fecha de la factura original. Hay una tarifa de $25 para usar el proceso de disputa. Si la agencia que revisa la disputa está de acuerdo con usted, entonces se deberá el monto de la estimación de buena fe. Si la agencia no está de acuerdo con usted y está de acuerdo con Bay Area Dental Surgery Center, deberá pagar el monto más alto.
